Coaching Company may collect some Personal Information directly from you via the Website (for example, when you submit a form via the Website). Such information may include your name, email address, any message content you submit, and the subject of your inquiry.

Coaching Company may also collect Personal Information directly from you if you use Coaching Company’s services, such as billing information, or any information you provide to Coaching Company via phones, videoconferencing platforms, or other telecommunications services.

When you visit the Website, Coaching Company uses cookies, log files, pixel tags, local storage, and/or other tracking technologies that allow Coaching Company’s server to collect data about the type of computer you are using, the type of browser you are using, your internet protocol (“IP”) address, the web-link that directed you to the Website, the search term you may have used to find the Website, the time and date you came to the Website, the content on the specific webpage you are viewing, and anything you might download (collectively, the “Analytics Data”).

Coaching Company may also receive Personal Information about you via third parties with whom you have a direct relationship (such as a ketamine clinic where you are receiving services).

For example, Coaching Company might notice that data Coaching Company monitoring indicates a distributed denial of service attack. In that scenario, Coaching Company would use automatically collected Personal Information (such as your IP address) to enact defenses and to protect the Website.

Coaching Company may also collect Personal Information through “Clear GIFs” (a.k.a. web beacons, web bugs, or pixel tags). Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. Unlike cookies, which are stored on your computer's hard drive, Clear GIFs are embedded invisibly on web pages. Coaching Company may use Clear GIFs for purposes including tracking the activities of Website visitors, managing content, and compiling statistics about Website usage. Coaching Company may use Clear GIFs in emails to help track email response rates, identify when emails are viewed, and track whether emails are forwarded.

Coaching Company does not control third party privacy practices

Coaching Company may link to other websites (for example, social media platforms, or other third-party websites) whose data practices may be different. Your use of any services offered by Coaching Company may also involve third parties, such as phone companies and videoconferencing providers. Coaching Company does not have any control over information that is submitted to or collected by third parties, so you should read their privacy policies, too.


Disclosure of your Personal Information

Coaching Company may share or disclose collected Personal Information with the following categories of third parties: 

  • To Coaching Company’s advisors (e.g. legal counsel, accountants, tax advisors, etc.) and auditors.

  • To third-party software platforms or third-party data hosting or analytics programs, in order to run and operate the Website and enhance the user experience. The Collected Data may be processed and shared with those platforms or programs as it is processed through their systems. 

  • Personal Information you provide over email, text message, telephone, or videoconference will be processed through Coaching Company’s email system, email host provider, internet host provider, website host provider, telecommunications provider, and/or videoconferencing provider. 

  • To vendors who provide services to help run Coaching Company’s business (such as payment processors, banks, accounting firms, and third-party software services). Coaching Company does not itself keep your full credit or debit card details.

  • Information may be shared with law enforcement, regulators, or other legal entities in order to comply with a judicial proceeding, a subpoena, a request from a regulator, or other legal obligation.

  • To necessary parties if Coaching Company believes that such disclosure is necessary to otherwise protect and/or defend our rights, property, safety or that of Coaching Company’s clients or other users of the website.

  • Coaching Company does not and will not sell any Personal Information Coaching Company receives from or about you.

  • Coaching Company does not and will not share sensitive Personal Information (e.g. race, religion, political affiliation, sexual orientation, etc.) with third parties without your express consent, except as required by law or where you have your own direct relationship with the third party (e.g. ketamine clinic).

Coaching Company takes reasonable steps to protect your Personal Information against unauthorized access, improper use or disclosure, or accidental loss. However, Coaching Company does not guarantee that such measures are perfect or impenetrable. Any use of technology poses risks, including the risk of technical failures, disruptions, hacking, unauthorized access, etc. You are responsible for maintaining the security of your passwords, logins, devices, and network connections.

Disclaimer of warranty; limited liability

The Website is offered “as is” and on an “as available” basis. Coaching Company does not provide legal, medical, pharmacological, psychiatric, or psychological advice. Coaching Company makes no warranty as to the accuracy, completeness, or reliability of any information provided through the Website, or any results that may be obtained from using information provided through the Website. Coaching Company disclaims and any all representations, warranties and conditions, whether express or implied, as to the operation of the Website, or any services accessible through or offered in connection with the Website, including but not limited to those of noninfringement, merchantability, and fitness for a particular purpose. In no event are Coaching Company or any principals, officers, directors, or employees it may have liable to you for any indirect, consequential, or special damages.

Data retention practices

Coaching Company will retain your Personal Information for the period of time necessary to fulfill the purposes outlined in this Privacy Policy, including for any period of time appropriate for asserting or defending Coaching Company’s legal rights as required or permitted under applicable laws and regulations.

California Civil Code Section §1798.83 (“Shine the Light” law) permits website users who are California residents to request certain information regarding Coaching Company’s disclosure (if any) of Personal Information to third parties for their direct marketing purposes. Coaching Company does not share Personal Information with third parties for the third party’s direct marketing purposes.

Coaching Company may ask you to verify your identity in order to respond. The Website does not respond to “Do Not Track” (DNT) signals.

If you would like to unsubscribe from email newsletter or marketing communications, please click the unsubscribe link at the bottom of the email. Even if you opt-out of such communications, Coaching Company may still send you important non-marketing messages relating to services you have selected.

Changes

Coaching Company may update this Privacy Policy to reflect changes to Coaching Company’s data practices. If Coaching Company proposes to make any material changes, Coaching Company will notify you by means of a notice on this page prior to the changes becoming effective.
